{"id":238,"date":"2020-10-22T19:49:07","date_gmt":"2020-10-22T19:49:07","guid":{"rendered":"https:\/\/tutator.net\/?post_type=news&#038;p=238"},"modified":"2024-11-15T15:33:15","modified_gmt":"2024-11-15T15:33:15","slug":"building-a-specialized-prosecutors-office-in-the-juvenile-justice-system","status":"publish","type":"news","link":"https:\/\/tutator.net\/fr\/news\/building-a-specialized-prosecutors-office-in-the-juvenile-justice-system\/","title":{"rendered":"Building a Specialized Prosecutor\u2019s Office in the Juvenile Justice System"},"content":{"rendered":"<p><img fetchpriority=\"high\" decoding=\"async\" class=\"wp-image-2255 size-full aligncenter\" src=\"https:\/\/tutator.net\/wp-content\/uploads\/2020\/10\/logos.png\" alt=\"\" width=\"817\" height=\"246\" srcset=\"https:\/\/tutator.net\/wp-content\/uploads\/2020\/10\/logos.png 817w, https:\/\/tutator.net\/wp-content\/uploads\/2020\/10\/logos-300x90.png 300w, https:\/\/tutator.net\/wp-content\/uploads\/2020\/10\/logos-768x231.png 768w\" sizes=\"(max-width: 817px) 100vw, 817px\" \/><\/p>\n<p style=\"text-align: left;\">As civil society institutions that contribute to Restorative Juvenile Justice in Bolivia we,<\/p>\n<ul>\n<li><a href=\"https:\/\/www.facebook.com\/CDC.Bolivia\/\" target=\"_blank\" rel=\"noopener\">Capacitaci\u00f3n y Derechos Ciudadanos (CDC)<\/a>,<\/li>\n<li><a href=\"https:\/\/www.facebook.com\/Progettomondo.mlalBolivia\" target=\"_blank\" rel=\"noopener\">ProgettoMondo Mlal<\/a> and<\/li>\n<li><a href=\"https:\/\/tutator.net\">Fundaci\u00f3n Tutator Bolivia<\/a>,<\/li>\n<\/ul>\n<p>want to highlight the work of the members of the Bolivian Adolescent Criminal System. In this communiqu\u00e9 we make special mention of the Public Ministry, in its commitment to specialize the Juvenile Justice unit of the Public Prosecutor\u2019s Office.<\/p>\n<p>With the approval of the Child and Adolescent Code (CNNA, 2014), Bolivia assumed the challenge of building a specific \u201cspecialized\u201d system of Criminal Justice for Adolescents. Thus, this norm determines that, in addition to the responsibilities established by the Organic Law of the Public Ministry, there are specific attributions of the Specialized Prosecutors:<\/p>\n<p>\u2013 Promote and require the de-judicialization, whenever it is appropriate, and<\/p>\n<p>\u2013 Promote and require the application of alternative measures. (Art. 275)<\/p>\n<p>In both of these responsibilities, the prosecutor\u2019s office must review and monitor compliance with the new restorative justice mechanisms. Thus, it should put in place:<\/p>\n<ul>\n<li><strong>Specialized prosecutors. <\/strong>This implies that in each department there should be prosecutors who are responsible for hearing cases in which an adolescent is alleged to have committed a crime.<\/li>\n<li><strong>The permanent training of these prosecutors.<\/strong> Indeed, having a specialized system means that, in addition to having specific prosecutors to handle cases of adolescents with criminal responsibility, these prosecutors must be trained to respond to the objectives pursued by the Criminal Justice for Adolescents and Restorative Justice.<\/li>\n<\/ul>\n<p>In this scenario, the State Attorney\u2019s Office assumed this commitment in 2019 with the creation of specialized prosecutor\u2019s offices: among them, the Specialized Prosecutor\u2019s Office for Juvenile Criminal Justice and Environmental Crimes.<\/p>\n<p>As a result of this effort and with the support of civil society, there are now 11 specialized prosecutors throughout the country. Measures were taken to train these prosecutors, under a principle of specialization. In this regard, the State Attorney General\u2019s Office, with the support of CDC, ProgettoMondo and <a href=\"https:\/\/tutator.net\/projects\/\">Tutator<\/a>, in 2019 put in place a training process with the participation of national and Peruvian experts, in international and national standards in criminal justice for adolescents.<\/p>\n<p>To facilitate the training of prosecutors who do not have access to the Internet a virtual course that functions off-line occurred in September 2020. Thus, more than 538 prosecutors were trained in the country, including Directors and Senior Prosecutors.<\/p>\n<p>In addition to the above, it is worth noting the participation of the prosecutor\u2019s office in various spaces of inter-institutional coordination.
